General Terms and Conditions (GTC) of hulaya

1. Scope

These General Terms and Conditions (hereinafter "GTC") apply to all legal transactions made via the online platform www.hulaya.com (hereinafter "Platform"). The Platform is operated by hulaya, Stuckishausstrasse 11, 3037 Herrenschwanden, Switzerland.

These GTC govern the legal relationship between hulaya and its users (dance studios, instructors, and dancers). hulaya reserves the right to change these GTC at any time. The version valid at the time of booking applies. Conflicting user conditions are not accepted.

2. Services and Pricing

  • Dance studios and instructors pay a monthly fee of 15 CHF to publish and manage their offerings on the platform.

  • hulaya charges a 5% platform commission per booking.

  • In addition, a 3% transaction fee is charged by the payment provider (Stripe), resulting in a total commission of 8%.

2.1 Dance Camps

  • If a dance camp booking exceeds 100 CHF, hulaya charges a 4% platform commission (plus 3% Stripe fee = 7% total).

  • If a dance camp booking is 100 CHF or less, hulaya charges a 5% platform commission (plus 3% Stripe fee = 8% total).

All displayed prices are final prices and include applicable taxes and fees unless stated otherwise.

3. Availability and Scheduling

hulaya strives to keep the availability and scheduling of classes accurate. However, changes may occur due to cancellations, instructor illness, or other unforeseen circumstances. Therefore, all availability information is non-binding.

4. Booking and Contract Formation

The listing of services on the platform constitutes a non-binding offer. A contract between the user and the studio/instructor is formed upon booking confirmation and successful payment.
hulaya acts solely as a technical intermediary and is not a party to the service contract.

5. Cancellation and Refund Policy

Cancellation terms are defined individually by each dance provider. hulaya does not manage or guarantee refunds. Any refund claims must be made directly with the respective studio or instructor.

6. Liability Disclaimer

hulaya assumes no responsibility for the execution or quality of the services offered by studios or instructors.
hulaya is not liable for damages resulting from the use of the platform, except in cases of gross negligence or willful misconduct.
hulaya is not liable for service interruptions due to technical issues.

7. Warranty

hulaya makes no guarantees regarding the uninterrupted availability or error-free operation of the platform. The accuracy of information provided by studios and instructors is not guaranteed by hulaya.

8. Data Protection

Personal data is collected and processed in accordance with Swiss data protection laws.

9. Termination

Users may cancel their accounts at any time. hulaya may suspend or terminate access without notice in case of violations of the GTC or misuse of the platform.

10. Amendments to the GTC

hulaya reserves the right to modify these GTC at any time. Updates will be published on the platform. Continued use of the platform implies acceptance of the updated terms.

11. Jurisdiction and Governing Law

Swiss law applies. The exclusive place of jurisdiction for all disputes is Bern, Switzerland.
